Defended Action - Where the defendant files a defence it is critical that a thorough investigation is carried out to establish the validity of the complaints. If the complaints, or part of are justified you should take immediate steps to correct the position.
It is possible the defendant may not fully understand, or may have a genuine complaint. We would advise speaking to the defendant to establish what the exact problem is. This will help avoid unnecessary legal expenses.
Is Your Defendant Playing For Time? You may feel after considering the defence that your debtor is playing for time. If the defence has no merit you must decide whether you wish to ‘short circuit’ the full trial and apply for Summary Judgment. Should your case reach this stage we will discuss this matter with you further.
